    Resumo: Neste artigo, investigamos a concepção nietzschiana para a “filosofia do direito”. Assim, apresentamos a hipótese de que o autor possui uma conceituação heterodoxa acerca da filosofia do direito, podendo ser entendida numa perspectiva genealógica. Para coloca-la à prova, analisamos um fragmento póstumo de 1883 em três momentos: incialmente, apresentamos a crítica nietzschiana à filosofia do direito de Rudolf von Jhering.
